The Corporate, External and Legal Affairs (CELA) department plays an important role in not only addressing the company's commercial, institutional and regulatory needs as a trusted advisor, but also in mitigating risks and managing a wide and diverse litigation portfolio.
CELA Brazil is looking for a Litigation Attorney who will act as the primary legal contact for multiple stakeholders providing general legal advice mainly to support the functions and to prevent and manage consumer and enterprise litigation.
Responsibilities
• Legal Advice and Counsel - You act as the primary legal contact for a product, product feature, team, or corporate function and you execute and/or resolve legal matters; you advocate for Microsoft's needs; you actively participate in legal, work, or industry associations; you monitor and exemplify legal compliance policy/standards and advise clients on compliance issues.
• Subject Expertise - You provide actionable advice on legal and business matters and serve as an important contributor for clients and colleagues; you have an in-depth understanding of the product and you engage with colleagues to identify and share best practices; you have an understanding of legal principles and interpret legal information.
• Solution Implementation - You identify, anticipate, and develop solutions to mitigate legal risks; you manage project work expenses according to budget and provide feedback to the improvement of project operations.
• Issue Resolution - You resolve issues by managing interactions with outside counsel or other service providers.
• Communication - You organize and simplify issues and ideas in written or verbal communication and you structure, draft, and negotiate transactional documents; you work collaboratively within and across Legal and Corporate functions; you develop positive relationships with external and legal professions, customers, and partners to advocate for Microsoft's interests.
• Litigation/Consultation: Act as the primarily legal contact for multiple stakeholders, both on providing general legal advice, mainly to support functions, but also on preventing and managing litigation from both consumer and enterprise nature.
Qualifications
Knowledge, Skills and Abilities
• Negotiations - The ability to achieve mutually satisfying agreements in negotiations with others by listening to their objectives, acting as the company's representative to effectively communicate the company's objective, and seeking common ground and collaborative solutions.
• Legal Acumen - The ability to interpret, analyze, and advise on the company's legal position. This includes the ability to apply knowledge of the legal framework related to one's practice area, use legal information to diagnose key issues, and develop strategies and plans.
• Contract Law - Knowledge of the principles and precedents regarding contract law and the ability to apply this knowledge to draft and negotiate contracts using legal information to accurately diagnose business realities, identify key issues, and develop strategies and plans.
• Legal Proceedings - Knowledge of legal proceedings, legal terminology, and the implications of court rulings. This includes the ability to integrate one's own expert knowledge into useful information for internal and outside legal counsel.
• Creative Legal Thinking - The ability to develop and present creative arguments and opinions to support the organization, defend cases, or negotiate solutions.
• Relationship Management - The ability to develop and maintain positive working relationships with supervisors, staff, managers, customers, and vendors. This includes expressing empathy and compassion when dealing with the needs and problems of others, being approachable, taking time to address the concerns of coworkers, and treating others with respect and dignity.
• Client Communications - The ability to communicate clearly, diplomatically and effectively to an audience that may include, staff, investors, stockholders, stakeholders, clients, and others verbally and through announcements, newsletters, memos, annual reports, status reports, and other media.
Required/Minimum Qualifications
• Completion of a Legal Apprenticeship OR Juris Doctorate Degree or Equivalent International Degree
• Active license to practice law in a jurisdiction and capable of meeting admission requirements in relevant jurisdiction
• 15+ years experience as a practicing attorney or equivalent practice of law
Additional or Preferred Qualifications
• 3+ years experience as an attorney in specialized practice area (e.g., tax, employment, copyright)
• In-house counsel experience
• Excellent written and spoken English and Portuguese. Spanish a plus.
