This role will have responsibility for being the legal point for the Commercial Contract Operation team, and will be responsible to provide advice and counsel to BMS negotiating teams on all price/discount agreements and fee for service agreements across therapeutic areas and customer channels.  This role will be required to work across a number of functional groups. The ideal candidate must have strong communication and collaboration skills, be proactive, and be able to prioritize and manage multiple projects and clients, as well as negotiate the terms of our agreements with key customers across channels and therapeutic areas.  This person will operate as part of the Law Department focused on providing excellent, pragmatic, solution oriented services to clients.

Key Responsibilities and Major Duties

  • Provision of proactive, practical, solution-oriented legal advice to help BMS appropriately craft and communicate our discount and fee for service agreements with purchasers and service providers with wholesalers, specialty pharmacies, GPOs, PBMs, MCOs, and organized customers.
  • Serves as the primary legal point for the Contract Operations teams and Negotiating Teams in developing offers to customers and negotiating the terms of our agreements
  • Collaborate across CV, Immunology, Hematology & Oncology legal colleagues and Law Department matrix to ensure delivery of seamless, comprehensive legal advice.
  • Leverage knowledge of emerging legal and industry issues and trends to inform advice and address potential legal risk.
  • Anticipate and proactively identify legal issues applying an enterprise view, and provide clear, operational and effective legal advice the supports informed decisions.
  • Deliver effective presentations to Law Department/ Business Units.
  • Lead and organize functional or substantive working groups assessing significant legal issues.

Requirements

  • Education: A law degree from an accredited US Law School
  • Must be licensed to practice law in NJ or have the ability to obtain
  • Knowledge: Broad knowledge of healthcare law, including advertising and promotion, anti-kickback and bribery laws, regulatory policy, and contracts.  Deep knowledge of US healthcare laws as they relate to HEOR, FDAMA 114, patient support programs, payer relationships and communications ideal.
  • Experience: At least 3  years of legal experience, preferably with a law firm that advises the healthcare/pharmaceutical industry on US market access and US government policy issues or in-house at a pharmaceutical or biotech or medical device company working on market access and US government policy issues.  Successful experience in cross-functional interactions is required.
  • Skills: Superior personal integrity and ethics, including an exceptional sense of discretion. 
  • Demonstrated ability to establish and maintain strong relationships across the business and within the Law Department. 
  • Ability to negotiate collaboratively to maintain/enhance relationships without sacrificing business or legal objectives. 
  • Ability to prioritize multiple projects under deadline pressure. 
  • Ability to communicate complex issues clearly, verbally and in writing.
