Position Summary

The Claims and Change Manager will be responsible to ensure the effective administration of contractual changes and claims. Responsible for the development and implementation of a Project Claims and Change Management Program. Duties and responsibilities include formulating strategies in consultation with Management and internal and external Legal counsel to provide overall direction for the Project team and implementing the necessary policies, processes, and procedures for effective change management with the help of subordinate managers.

 

Responsibilities:

  • Working on dispute resolution, mediation assistance, claims defense and high-level claim report writing on behalf of customer.
  • Under limited supervision, using independent judgment, manage claims and disputes from contractors in accordance with the Contractual Agreement and all customer standards.
  • Provide subject matter expertise in all aspects of claims management.
  • Manage and maintain comprehensive claims documentation within the contract administration software.
  • Lead all claims and change management with respect to customers, Project Cos and third-party claims.
  • Investigate, evaluate, and provide recommendations for the settlement of claims.
  • Provide detailed evaluation of potential claim impact to the Project Management team.
  • Provide summary reports to Executive Management.
  • Liaise with customer legal team on an as needed basis
  • Devise and implement alternative dispute resolution techniques.
  • Effectively and positively influence stakeholders to comply with claims process as set out in the Project Agreement(s).
  • Analyze contract general terms and conditions to highlight areas of risk such as ambiguities, conflicts or deviations from the scope of work. As work proceeds, make recommendations to the Project Manager on the mitigation of these risks; closely monitor and support remedial actions and recommend appropriate tradeoffs.
  • Responsible for the development and management of a procedure to recognize and identify contract claims as they develop and manage the timely resolution under the changes provisions wherever possible, obtaining claims and legal expertise as appropriate.
  • Independently or in conjunction with the Project Manager and other senior staff, negotiates alongside customers on behalf of the project. Works with customer representatives on a day-to-day basis to interpret provisions of contracts as they relate to claims, changes, quantities, costs, estimating, scheduling, finance, accounting, project administration and business funding.
  • Provides analysis of financial information, estimates of administrative costs, and the preparation of forecasts and cost and performance reports for the claims management program. 

 

Qualifications and Skills:

Basic Qualifications

Level One:  

  • Bachelor’s or Master’s degree (or international equivalent) and a minimum of 15+ yrs experience, or 19+ yrs relevant work experience in lieu of a degree
  • Working knowledge of contract law

Level Two:

  • Bachelor’s or Master’s degree (or international equivalent) and a minimum of 17+ yrs experience, or 21+ yrs relevant work experience in lieu of a degree
  • Strong knowledge of contract law
  • Experience of working with delay claims, productivity claims, acceleration and extensions of time
  • Experience in arbitration and dispute resolution services
  • Be commercial astute, responsive and act quickly under changing circumstances
  • Highly organized and ability to process and efficiently manage numerous claims
  • Experience in contract administration and document management software’s such as Primavera Unifier, CM14, etc.
